By downloading or using Chickpea ("the app"), you agree to these terms. If you don't agree, please don't use the app.
1. What the app does
Chickpea lets you record, caption, and store voice memories of your children on your device. An optional cloud backup feature is available with a Chickpea Pro subscription.
2. Your data is your responsibility
You are responsible for your own data. The app includes an Export feature (Account → Export all recordings) that lets you save your recordings as audio files to your phone at any time. We strongly recommend using this regularly.
Cloud backup (Chickpea Pro) is provided as a convenience and is not a substitute for your own backups. We make no guarantee that cloud backups will be available indefinitely or that data will never be lost due to technical failures, account issues, service changes, or discontinuation of the service. We will endeavour to keep the service running for as long as possible, but we cannot be held responsible for any data loss, whether due to device loss, accidental deletion, service outages, or any other reason.
We are not liable for any loss of recordings, captions, or other data stored in the app or its cloud backup.
3. No warranty
The app is provided "as is" without warranty of any kind — express or implied — including but not limited to warranties of merchantability, fitness for a particular purpose, or uninterrupted availability. Use the app at your own risk.
4. Subscriptions
Chickpea Pro is a paid subscription that unlocks cloud backup and other features. Subscriptions are billed through Google Play (or Apple, as applicable). You can cancel at any time through your device's subscription settings. Refunds are subject to Google Play's or Apple's own refund policies.
5. Acceptable use
You may only use Chickpea for lawful purposes. You agree not to use the app to record individuals without their knowledge where required by law, or to store any content that is illegal in your jurisdiction.
6. Service changes
We reserve the right to modify, suspend, or discontinue any part of the app or its cloud service at any time, with or without notice. We will make reasonable efforts to provide advance notice of significant changes.
7. Limitation of liability
To the fullest extent permitted by law, Chickpea and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of recordings, or loss of profits, arising out of or in connection with your use of the app.
8. Governing law
These terms are governed by the laws of Australia, without regard to conflict of law principles.
